STATEN ISLAND, N.Y. -- While millions of Americans have received a third stimulus payment, some of those people will have to return their $1,400 check to the Internal Revenue Service (IRS). To qualify for the full stimulus payment, an individual must have an adjusted gross income of $75,000 or below. For individuals who are the head of household, the adjusted gross income must be $112,500 or below. If you’re a married couple filing jointly, total yearly earnings must be $150,000 or below to receive the full stimulus check. Unlike the first two stimulus payments, the third payout is not restricted to children under 17. Eligible families will get a payment based on all of their qualifying dependents claimed on their tax return, including older relatives, like college students, adults with disabilities, parents and grandparents. But some people who received the full $1,400 may be asked by the IRS to give back the money. According to Kiplinger, here’s some reasons people may need to return their stimulus money:

Nonresident aliens are not eligible. A nonresident alien includes anyone who:

isn’t a U.S. citizen,

is without a green card,

or has not been physically present in the country for the required amount of time. However, resident aliens with a valid Social Security number not claimed as a dependent on someone else’s tax return, can keep the $1,400, according to the IRS. Surviving spouses can’t keep a deceased partner’s check who died before Jan. 1, 2021. According to the AARP, the federal government has sent stimulus payments to about 1.1 million dead people totaling nearly $1.4 billion. If a husband or wife died before January 1, 2021 and received a third stimulus check, the check for the deceased spouse must be returned to the IRS. The one exception is if the person who died is a married member of the U.S. military. In that case, the surviving spouse can receive the third stimulus check. Some people may not be able to cash their stimulus check if it was issued jointly to a couple where one spouse is now deceased. In this situation, you can return the money to the IRS with a letter requesting that a payment be reissued in the surviving spouse’s name only.

Instead of mailing the check back to the IRS, people could consider donating the money to charity or to local businesses that may be suffering due to the coronavirus (COVID-19) pandemic.

RETURNING THE STIMULUS

If the payment was a paper check and hasn’t been cashed, the AARP says you can write “Void” over the endorsement section on the back of the check and then mail it back to the IRS with a note for the reason it’s being returned. If the payment was a direct deposit or a paper check that was cashed, you can submit a personal check, money order or bank check to the appropriate IRS location for your state. The check/money order should be made payable to “U.S. Treasury.” Write “2020EIP,” and the taxpayer identification number of the recipient of the payment in the notes section of the check.
